These Terms of Service ("Terms") govern your access to and use of the Tartol platform, including the website at tartol.com, web application, API, Chrome browser extension, and all related services (collectively, the "Service"), operated by Tartol ("we", "us", "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Account
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating your account.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorized access to your account.
- We may suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
3. Subscriptions and Billing
3.1 Plans and Credits
The Service is offered on a subscription basis with tiered plans. Each plan includes a monthly allocation of AI credits. Credits are consumed when you use AI-powered features (image generation, copy generation, compliance checks, audio generation, etc.). Unused monthly credits do not roll over. Extra credits do not expire.
3.2 Payment
Subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information current.
3.3 Free Trials
We may offer free trials at our discretion. Trials include a limited credit allocation. At the end of the trial period, you will be charged for the selected plan unless you cancel before the trial ends. We reserve the right to limit trial eligibility (e.g., one trial per person or organization).
3.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to the Service until then. We do not provide prorated refunds for partial billing periods.
3.5 Refunds
Subscription payments are generally non-refundable. If you believe you were charged in error, contact us within 14 days of the charge. Credit pack purchases are non-refundable once credits have been used. Unused credit packs may be refunded within 7 days of purchase at our discretion.
3.6 Price Changes
We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle. If you do not agree with a price change, you may cancel before it takes effect.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Create deceptive or misleading advertisements
- Infringe on the intellectual property rights of others
- Distribute malware, spam, or phishing content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated tools to access the Service in a manner that exceeds reasonable use (scraping, bots, etc.)
- Resell, sublicense, or redistribute the Service or AI-generated outputs as a competing service
- Use the Service to build a product or service that competes with Tartol
We reserve the right to suspend or terminate your account for violations of this section without prior notice.
5. Content Ownership and Licenses
5.1 Your Content
You retain ownership of content you upload to the Service (brand assets, product images, scripts, etc.). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.
5.2 AI-Generated Content
Content generated by AI through the Service (images, copy, audio, video) is owned by you, subject to the following:
- AI-generated outputs may not be fully unique. Other users may generate similar content from similar inputs.
- You are solely responsible for ensuring that AI-generated content complies with applicable laws, advertising platform policies, and intellectual property rights before publishing.
- We make no representation that AI-generated content is free from errors, bias, or infringement.
- The compliance checker is an AI-powered tool and does not constitute legal advice. You are responsible for final compliance decisions.
5.3 Saved Ads and Research Data
The Service allows you to discover, save, and organize publicly available advertisements from platforms such as the Facebook Ad Library and Google Ads Transparency Center. This data is sourced from public ad transparency databases. You may use saved ads for research and inspiration purposes. You may not republish, redistribute, or claim ownership of third-party ad creatives.
5.4 Our Content
The Service, including its design, features, code, documentation, and branding, is owned by Tartol and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
6. Brand Tracker
The Brand Tracker feature monitors publicly available ads from competitor brands using data from public ad transparency databases. You acknowledge that:
- Tracked data is sourced from publicly available ad libraries and transparency tools
- We do not guarantee the completeness or accuracy of tracked data
- Ad platform policies may change, which could affect data availability
- You are responsible for how you use competitive intelligence gathered through this feature
7. Chrome Extension
The Tartol Chrome Extension allows you to save ads while browsing the Facebook Ad Library and Google Ads Transparency Center. The extension:
- Only activates on facebook.com/ads/library and adstransparency.google.com pages
- Does not track your browsing history or activity on other websites
- Transmits ad data to our servers only when you explicitly choose to save an ad
- Requires authentication with your Tartol account
8. Team Workspaces
If you invite team members to your workspace:
- You are responsible for your team members' compliance with these Terms
- Team members share access to workspace data (brands, products, campaigns, saved ads)
- The workspace owner controls member access and can remove members at any time
- Credits are shared at the account level, not per team member
9. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide reasonable advance notice when possible)
- Unplanned outages or technical issues
- Third-party service disruptions (AI providers, payment processors, hosting infrastructure)
- Force majeure events
We are not liable for any loss or damage resulting from Service unavailability.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, COMPLIANT WITH ANY LAW, OR FREE FROM INFRINGEMENT.
- OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
- WE ARE NOT LIABLE FOR THE ACTIONS, CONTENT, OR POLICIES OF THIRD-PARTY SERVICES INTEGRATED WITH THE PLATFORM.
11. Indemnification
You agree to indemnify and hold harmless Tartol, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Content you create, upload, or publish using the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Advertisements you create or publish based on AI-generated content or competitor research
12. Termination
- You may close your account at any time through your account settings or by contacting us.
- We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
- Upon termination, your right to use the Service ceases immediately. We may retain your data as described in our Privacy Policy.
- Sections 5, 10, 11, 13, and 14 survive termination.
13. Dispute Resolution
Any dispute arising from these Terms or the Service shall be resolved as follows:
- Informal resolution — Contact us first. We will attempt to resolve the dispute within 30 days.
- Binding arbitration — If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the applicable arbitration body in the jurisdiction of our principal office. You waive any right to participate in a class action.
Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations or unauthorized access.
14. General
- Governing law — These Terms are governed by the laws of the jurisdiction in which Tartol operates, without regard to conflict of law principles.
- Entire agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tartol.
- Severability — If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver — Failure to enforce any right or provision does not constitute a waiver.
- Assignment — You may not assign your rights under these Terms. We may assign our rights in connection with a merger, acquisition, or sale of assets.
- Modifications — We may update these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.
